Homicide in Nebraska: Facts to Know
Not all homicide charges are the same in Nebraska, and understanding what you’re facing is the first step toward building a strong defense. Nebraska law recognizes several distinct categories of homicide with different legal elements, sentencing ranges, and strategic considerations.
First-Degree Murder is the most serious charge you can face in Nebraska. Under Nebraska Revised Statutes § 28-303, first-degree murder is charged when the prosecution alleges that a killing was premeditated or that it occurred during the commission of another serious felony, such as robbery, kidnapping, arson, or sexual assault.
According to the Nebraska Legislature’s official statutes, a conviction for first-degree murder carries a mandatory sentence of life imprisonment. In certain aggravated circumstances, however, the death penalty remains a possibility under Nebraska law.
Second-Degree Murder applies when the prosecution alleges an intentional killing that was not premeditated. There is no requirement that the act was planned, but the prosecution must still prove that the defendant acted with the intent to kill. And a conviction can still result in decades behind bars.
Homicide vs. Manslaughter in Omaha
Manslaughter is charged when a death is caused without malice, either during a sudden altercation or unintentionally while committing an unlawful act. Though it is considered less severe than murder in the eyes of the law, manslaughter is still a serious felony with life-altering consequences.
