Military Justice
In addition to the state and federal laws everyone must comply with, servicemembers are also subject to the Uniform Code of Military Justice or UCMJ. The UCMJ not only sets forth an altogether different code of criminal law applicable to servicemembers, but it also provides for an entirely different set of procedures that, in many cases, do not resemble state or federal systems at all. Because the military justice system is so different, it is imperative that you consult with an attorney who has actual experience working in the military justice system when facing any disciplinary action in the military.
Depending on your branch of service, you may find yourself being investigated by law enforcement assigned to the Air Force Office of Special Investigation (OSI), the Army’s Criminal Investigation Division (CID), the Naval Criminal Investigative Services (NCIS), or other military investigative agencies. Oftentimes these military agencies will partner with local or federal authorities as well. If you are notified that you are under investigation, our military justice team can help you through the process, ensure that all of your rights are preserved, and begin taking strategic actions to make sure that you are protected.
If you’re a servicemember facing a disciplinary action, our military justice team is here to help. Because our military justice team includes a former active duty Judge Advocate and military defense counsel, the Dornan Law Team appreciates and respects the capable attorneys who serve as defense counsel in the JAG Corps. But we also know that military defense counsel routinely carry heavy case loads and have to balance competing military obligations. We also know that military defense counsel oftentimes can only offer limited representation and advice when civilian authorities retain jurisdiction over your case. In these situations, it is best to have the assistance of a civilian attorney who can not only give your case the time and attention it deserves, but also knows how to partner with your military counsel to obtain the best possible result for you both inside and out of the military.
